Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy (“Health Data Policy”) supplements the Acurist.AI Privacy Policy and describes how Acurist.AI LLC (“Acurist,” “we,” “us”) collects, uses, and discloses “consumer health data” in connection with the website at acurist.ai (the “Site”). It is intended to address U.S. state consumer health data laws, including the Washington My Health My Data Act, the Nevada consumer health data law, and the health-data provisions of the Connecticut Data Privacy Act. Where this Health Data Policy and the Privacy Policy conflict with respect to consumer health data, this Health Data Policy controls.
1. What “consumer health data” means
“Consumer health data” generally means personal information that is linked or reasonably linkable to a consumer and that identifies the consumer’s past, present, or future physical or mental health status. For Acurist, this can include information related to cognitive function and brain health. This Health Data Policy does not apply to information governed by HIPAA or handled under the clinical agreements described in our HIPAA & Health Information Consumer Health Data notice.
2. Consumer health data we collect — and what we do not
Interactive assessments are processed in your browser. Answers you enter into the interactive Alzheimer’s Risk Profile and other self-assessment tools on the Site are processed locally within your own web browser to generate your results. These responses are not transmitted to, or stored by, Acurist through the Site.
Sharing a summary with your physician. If you choose to email a summary of your results to your physician, that message is created and sent through your own email application. Acurist does not receive, intercept, or retain a copy of it.
Information you volunteer. If you include health-related details in a free-text message, inquiry, or form submission, we receive and process the information you chose to send. Please do not include sensitive health details in form fields that do not request them.
3. Sources of consumer health data
Any consumer health data we hold comes directly from you — through information you choose to enter or send to us through the Site.
4. How we use consumer health data
- To respond to inquiries and requests you submit;
- To provide information, materials, or follow-up you have asked for;
- To operate, secure, and improve the Site;
- To comply with legal obligations.
We do not use consumer health data to deliver targeted or cross-context behavioral advertising.
5. How we share consumer health data
We do not sell consumer health data, and we do not share it for targeted advertising. We may disclose consumer health data only:
- To service providers and processors that perform functions on our behalf — such as our customer relationship management and website hosting providers — under contracts that restrict their use of the data to those functions;
- For legal compliance and safety, when required by law or legal process or to protect the rights, safety, or property of Acurist, our users, or others;
- In connection with a business transfer, such as a merger, acquisition, or sale of assets, subject to this Health Data Policy;
- With your consent or at your direction.
6. Your rights
Subject to applicable law, you have the right to:
- Confirm whether we are processing your consumer health data and access that data;
- Withdraw consent to our collection and processing of your consumer health data;
- Request deletion of consumer health data that we hold about you.
We will not deny you goods or services, or otherwise discriminate against you, for exercising these rights.
7. How to exercise your rights
To make a request, contact us at support@acurist.ai or 540-878-6754. We will take reasonable steps to verify your request and will respond within the time required by applicable law. If we decline a request, you may appeal by replying to our decision or contacting us at the same address; if an appeal is denied, you may contact your state attorney general.
8. Data security
We maintain reasonable administrative, technical, and physical safeguards designed to protect consumer health data. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. Changes to this Health Data Policy
We may update this Health Data Policy from time to time. The “Last updated” date above reflects the most recent revision, and material changes will be posted on this page.
